Union officials say that law enforcement officers followed many of their members home to arrest them instead of mailing citations, which is common for misdemeanors.
The union has made massive public records requests of emails from county officials related to the protests. ILWU attorneys cited an email from Rosenzweig dated Sept. 9, 2011, describing law enforcement’s response to the ILWU as “much more affirmative” and “intentional” than standard police actions.
In a separate instance, union attorneys said Baur was regularly involved in meetings with law enforcement plans to arrest ILWU members. Union attorneys allege Baur should have stayed away from those planning session to avoid tainting her prosecution.
