Seaway International Foods Ltd. of Dartmouth is suing Maersk Canada Inc. for breach of contract over a container-load of Australian beef that went bad when it was mistakenly left in Cleveland, Ohio.
“Seaway contracted with Maersk to ship a container of frozen Australian boneless beef to Montreal,” said a statement of claim made public in Nova Scotia Supreme Court. “Maersk was responsible pursuant to the contract with Seaway to arrange for transportation of the container from Philadelphia to Montreal.”
Maersk subcontracted with CSX Railway Ltd. for that portion of the trip, said the lawsuit.
“By error, CSX Railway shipped the container to Cleveland, Ohio, where the container went unmonitored and undetected until such time as the majority of the meat contained within spoiled and was lost.”
